La institucionalización de la justicia indígena: un análisis interdisciplinario de la pluralidad jurídica en el caso Ecuatoriano

Abstract:
This study is based on field research conducted in the summer of 2017 in Ecuador, with the aim of gathering firsthand information from indigenous activists, professors, and representatives of state institutions in order to develop an analysis that provides an academic perspective on Ecuador’s legal pluralism. The Ecuadorian democratic system, constitutionally grounded in a plurinational framework since 2008, serves as the foundation and rationale for analyzing the process of institutionalizing Indigenous Justice in Ecuador, which stems from its recognition and application under the 2008 Ecuadorian Constitution. In this report, we present an analysis of the first ten years of the state’s institutional relationship with Indigenous peoples and their ancestral justice system.
